These Terms and Conditions apply to your use of the Stoned Bikinis website and to purchases made through the website.
By using this website or placing an order, you agree to these Terms & Conditions.
1. About Stoned Bikinis
Stoned Bikinis creates handcrafted competition bikinis and stage accessories. Each piece is individually made and embellished by hand. Because of the handmade nature of our work, no two pieces will be perfectly identical.
2. Products and product descriptions
We take care to represent our products as accurately as possible through photographs, descriptions and other information provided on the website.
Colours may appear differently depending on your device, screen settings and lighting conditions.
Small variations in stone placement, finish, stitching and other handmade details may occur between pieces. These variations are a natural characteristic of individually handcrafted work and are not necessarily defects.
Where a design is recreated in a different size, the signature design, colour story and overall aesthetic will be maintained, while the final piece may have minor variations due to the individual handcrafted process.
3. Ready-to-wear pieces
Ready-to-wear pieces are completed pieces available for immediate purchase in the size stated on the product page.
The product page will provide information about the available size, fit, included items and relevant design details.
Customers are responsible for reviewing the available sizing information before purchasing.
If you are unsure about sizing, please contact Stoned Bikinis before purchasing so that we can assist you.
4. Made-to-order pieces
Some Stoned Bikinis designs may be available to recreate in alternative sizes by request.
Made-to-order pieces are individually handcrafted following confirmation of the requested size and design.
A made-to-order recreation may not be identical to the original photographed piece. The signature design and colour story will be maintained, but individual stone placement and other handmade details may vary.
Made-to-order availability is subject to the availability of suitable materials and Stoned Bikinis' ability to reproduce the design appropriately.
Estimated production time will be communicated before a made-to-order order is confirmed.
5. Sizing and measurements
Customers are responsible for providing accurate measurements and sizing information when requested.
Where hip measurements or other measurements are requested for fitting purposes, those measurements must be provided accurately.
We may provide sizing guidance based on the information supplied, but customers remain responsible for checking the sizing information provided and communicating any relevant fit requirements before an order is confirmed.
Where you are unsure about your size, we strongly recommend contacting Stoned Bikinis before placing an order.
Providing inaccurate measurements may affect the fit of a made-to-order piece.
Nothing in this section limits any rights you may have under the Australian Consumer Law.
6. Padding and fit adjustments
Where available, padding or other fit options may be discussed before an order is confirmed.
Any agreed fit requirements should be communicated before production of a made-to-order piece begins.
7. Pricing
All prices displayed on the Stoned Bikinis website are in Australian dollars (AUD).
Prices are subject to change without notice, but a price will not be changed after an order has been accepted and payment has been received, except where required by law.
We take care to ensure pricing information is accurate. If a genuine pricing error occurs, we may contact you before fulfilling the order to discuss the error and available options.
8. Payment
Payment must be successfully received before an order is considered confirmed, unless otherwise agreed in writing.
Payments are processed through third-party payment providers.
Stoned Bikinis does not store complete payment card details.
9. Orders and acceptance
Submitting an order through the website constitutes an offer to purchase the selected product.
An order is not considered accepted until payment has been successfully received and Stoned Bikinis has confirmed the order.
We reserve the right to decline or cancel an order where reasonably necessary, including where a product is unavailable, there has been a genuine pricing or product information error, or circumstances arise that prevent the order from being fulfilled.
If we cancel an order after payment has been received, the amount paid for the cancelled order will be refunded.
10. Handmade nature of our products
Stoned Bikinis pieces are individually handcrafted and heavily embellished.
The handmade nature of each piece means that minor variations may occur in:

stone placement
-
stone orientation
-
colour distribution
-
stitching
-
trims
-
embellishment density
-
other small finishing details.
These variations contribute to the individual character of each piece.
They do not affect the customer's rights under the Australian Consumer Law where a product does not meet the applicable consumer guarantees.
11. Returns and change of mind
Because Stoned Bikinis pieces are highly specialised, individually handcrafted competition garments, we do not generally accept returns or exchanges where a customer has simply changed their mind.
This may include circumstances where a customer:

changes their preferred colour or design

decides they no longer want the piece
-
orders an incorrect size after having had the relevant sizing information available

no longer requires the garment for a particular competition
-
finds that their personal preference has changed after purchase.
For made-to-order pieces, we do not generally accept cancellations or returns for change of mind once production has commenced.
However, nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law.
12. Faulty, damaged or incorrectly supplied products
If a product is faulty, damaged before delivery, significantly different from its description, or otherwise does not meet an applicable consumer guarantee under the Australian Consumer Law, please contact us as soon as reasonably practicable.
We may ask for photographs or other information to help assess the issue.
Where required by law, Stoned Bikinis will provide the applicable remedy, which may include a repair, replacement, refund or other appropriate remedy depending on the circumstances.
13. Shipping and delivery
Australian orders are currently offered with complimentary shipping.
International orders are currently charged a flat shipping rate of AU$60.
Estimated international delivery time is currently 7–14 business days, although actual delivery times may vary depending on destination, carrier, customs processing and circumstances outside our control.
Once an order has been dispatched, tracking information may be provided where available.
Stoned Bikinis is not responsible for delays caused by postal carriers, customs authorities, weather events, international disruptions or other circumstances outside our reasonable control.
International customers are responsible for any applicable customs duties, taxes, import charges or other fees imposed by the destination country.
14. Delivery address
Customers are responsible for providing an accurate delivery address.
If an order is returned to Stoned Bikinis because an incorrect or incomplete address was provided, additional shipping costs may apply before the order is resent.
15. Intellectual property and designs
All original designs, artwork, photographs, written content, branding, logos, product names and other creative material displayed on the Stoned Bikinis website remain the intellectual property of Stoned Bikinis or the relevant rights holder unless otherwise stated.
You must not reproduce, copy, modify, distribute, sell or commercially exploit Stoned Bikinis designs, photographs, artwork, website content or branding without prior written permission.
Purchasing a Stoned Bikinis piece does not transfer ownership of the underlying design or intellectual property.
16. Photography and social media
We may photograph Stoned Bikinis products for website, marketing and social media purposes.
We will not use identifiable photographs of customers for marketing purposes without appropriate permission.
Customers are welcome to share photographs of their Stoned Bikinis pieces and tag Stoned Bikinis on social media.
17. Website information
We aim to keep the information on our website accurate and current, but we do not guarantee that every piece of information will always be complete, current or free from error.
We may update, change or remove website content, products, pricing or availability from time to time.
18. Website use
You agree not to use the website in a way that:

interferes with the operation or security of the website

attempts to gain unauthorised access to systems or information

copies or misuses website content or intellectual property

19. Third-party services and links

Stoned Bikinis is not responsible for the content, security, availability or privacy practices of third-party websites or services.
Your use of third-party services may be subject to their own terms and privacy policies.
20. Australian Consumer Law
Nothing in these Terms and Conditions is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.
Where the Australian Consumer Law provides you with rights or remedies, those rights continue to apply.
21. Events outside our reasonable control
Stoned Bikinis will not be responsible for delays or inability to fulfil an order caused by circumstances reasonably outside our control, including natural disasters, severe weather, supply disruptions, carrier disruptions, government restrictions, major technology failures or other events beyond our reasonable control.
Where such circumstances occur, we will make reasonable efforts to communicate with affected customers and fulfil orders as soon as reasonably practicable.
22. Changes to these Terms
We may update these Terms and Conditions from time to time.
The current version will be published on this page and will include the date of the latest update.
Changes will not retrospectively alter rights or obligations relating to an order that has already been accepted, except where required by law.
